Technology is increasingly shaping social, economic, and political life in Kenya, but it has also amplified existing gender inequalities. This report positions Technology-Facilitated Gender-Based Violence (TFGBV) as a continuation of entrenched power imbalances that are now mediated through digital platforms. The report examines Kenya’s legal and regulatory framework, highlighting the gap between rapid technological advancement and existing laws. In the absence of legislation specifically addressing TFGBV, protection relies on adapting existing international, regional, and domestic legal instruments. The Constitution of Kenya, alongside subsidiary legislation and data protection laws, provides important safeguards through rights to dignity, privacy, security, content takedowns, and deactivation orders.
However, enforcement remains a major challenge, limiting access to justice for survivors. The report recommends a shift from reactive to proactive governance, emphasizing data governance as a critical component of digital safety.
