The New Wave of eHealth: AI and Privacy Concerns? A Case Study of Kenya

The objective of the report is to assess and analyse whether the right to privacy has been actualised within Kenyan AI eHealth platforms. This was done through examining the presence of privacy initiatives within the eHealth platforms, evaluating whether the privacy initiatives meet the legal threshold and assessing the efficacy of the design and structure of the privacy initiatives in place in relation to users understanding and applying their right to privacy. The above assessments assisted with supplying evidence as to why the privacy initiatives needed to be remodified as well as providing evidence for proposed legal reforms for the various gaps present.

The findings from the report indicate that:

  • There are existing laws in Kenya which are applicable to the regulation of eHealth.

  • Few Kenyan AI eHealth platforms have an existing website and privacy policy/commitment.

  • Modifications can be done on the privacy policies of Kenyan AI eHealth platforms to improve privacy protection of data subjects.

  • Legal reforms will play a fundamental role in enhancing privacy protection and also regulation of AI technologies.

The report contains the detailed analysis of the study that was conducted and the findings that were obtained.
